Joanna MacPherson

Joanna joined the JK Cameron team in 2014. Since then she has developed a wide and in-depth practice in the areas of Adoption and Child and Family Law.

She regularly acts on behalf of adopters as well as on behalf of clients affected by relationship breakdowns who require advice and representation in respect of financial provision upon separation, divorce, cohabitation, residence and contact issues. She has focused her practice particularly in the areas of Kinship Care Orders / Section 11 Orders.

She also has extensive experience in preparing and progressing Court of Session adoption applications for carers living out with Scotland and permanence order cases.

 

Experience

• Joanna has successfully pursued and defended numerous cases in relation to residence and contact actions. She has provided effective dispute resolution representation and litigation representation for clients seeking to resolve family disputes concerning children. She also undertakes guardianship cases and the drafting of separation agreements.
• Specialism in obtaining specific issues orders under section 11 of the Children (Scotland) Act 1995 in urgent cases for passports and court permission for foster carers, prospective adopters and kinship carers to travel with children on holiday where parents have refused such permission.
• Joanna has successfully represented clients out with Scotland who have required to raise proceedings at the Court of Session in relation to children in their care, obtaining adoption orders for those clients. This has required Joanna to show her depth of knowledge and skill in the legal and factual basis of cross border applications as well as preparing detailed affidavit evidence and instructing Counsel in representation at the Outer House in the Court of Session.
• Joanna has built up an extensive practice in pursuing Kinship Care Orders for those clients who have children in their care who are unable to reside with their parents. Those Kinship Care Order cases highlight Joanna’s extensive knowledge in this area and underscore her considered and compassionate approach to all child related matters.
